What Kaltrix is

Kaltrix is a driving-awareness tool that fuses telemetry from radar detectors with navigation. Alerts and map data are crowd-sourced and provided for informational purposes only. Kaltrix is not a substitute for attentive, lawful driving.

Your responsibility for the law

Radar detectors are restricted or prohibited in some jurisdictions and in certain vehicle classes. You are solely responsible for knowing and complying with all radar-detector, laser-detector, and related laws and regulations that apply to you, your vehicle, and every place you drive. Kaltrix does not provide legal advice, and using the app does not make any device or activity legal where it is not. You use radar-detector features entirely at your own risk.

Distracted-driving and safety

Do not interact with your phone while driving. Set your route and preferences before you move, mount your device safely, and keep your eyes on the road and hands on the wheel. You are solely responsible for operating your vehicle safely and for complying with all distracted-driving, hands-free, and traffic laws. Obey all speed limits, signs, and signals regardless of what any Kaltrix alert or map shows. Kaltrix must never be used to evade law enforcement or to encourage unsafe or illegal driving.

No warranty on accuracy

Crowd-sourced alerts, hotspots, routing, and detection data may be incomplete, delayed, or wrong. Kaltrix is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the app will detect any particular hazard, enforcement activity, or condition, or that it will be uninterrupted or error-free.

Accounts and acceptable use

Keep your login credentials secure and do not share your account. Do not submit false reports, abuse the telemetry network, attempt to de-anonymize other users, or interfere with the service. We may suspend or terminate accounts that violate these terms.

Kaltrix Pro subscriptions

Kaltrix is free to use. Kaltrix Pro is an optional auto-renewing subscription that unlocks aircraft detection, the historical enforcement heatmap, unlimited trip history and replay, and early access to new features. Pro is offered as a monthly or annual plan; the current price, billing period, and any free-trial length are shown in the app before you purchase and may vary by region. Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your Apple ID account settings at any time after purchase; deleting the app does not cancel it. If you are offered a free trial, any unused portion is forfeited when you purchase a subscription. Purchases are processed by Apple, so refunds are handled under Apple's policies and requested through Apple, not through us. We may change subscription pricing or the features included in Pro; price changes apply only to future billing periods and, where required, take effect only after notice and your consent. Your data and deleting it

How we collect, use, and share data is described in the Kaltrix Privacy Policy, which is part of these terms. You can permanently delete your account and associated personal data at any time from inside the app (Settings, then "Delete account") or by following the steps at kaltrix.app/delete-account. Deletion removes your account record and email and disassociates the anonymized, coarsened detection telemetry you contributed from your identity. Deletion is immediate and cannot be undone. To request a copy of your personal data, ask for a correction, or get help with a deletion request, email support@kaltrix.app.

Limitation of liability

To the fullest extent permitted by law, Kaltrix and its contributors are not liable for any tickets, fines, collisions, injuries, damages, or losses arising from your use of the app or reliance on its data, and are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, even if advised such damages are possible.

To the same fullest extent permitted by law, the total combined liability of Kaltrix and its contributors for all claims arising out of or relating to the app or these terms will not exceed the greater of fifty U.S. dollars ($50) or the total amount you paid to Kaltrix in the twelve (12) months before the event giving rise to the claim.

Some jurisdictions do not allow certain warranty exclusions or liability limits, so parts of this section may not apply to you; in that case our liability is limited to the smallest amount the law allows. Your use of Kaltrix is at your sole risk.

Indemnification

You agree to defend, indemnify, and hold harmless Kaltrix, its operator, and its contributors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with: your use of the app or of any radar detector or related device; your violation of these terms; your violation of any law or regulation, including radar-detector, distracted-driving, and traffic laws; or your violation of the rights of any third party. We may assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with that defense.

Arbitration and class-action waiver

Before filing any claim against Kaltrix, email support@kaltrix.app with a description of the dispute and give us thirty (30) days to try to resolve it with you informally.

Any dispute arising out of or relating to these terms or the app that we cannot resolve informally will be resolved by BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. Either you or Kaltrix may instead bring an individual claim in small-claims court if it qualifies there.

YOU AND KALTRIX EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. Disputes may be brought only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class proceeding. If the class waiver is found unenforceable as to a particular claim, that claim — and only that claim — must proceed in court instead.

You can opt out of this arbitration section entirely: email support@kaltrix.app within thirty (30) days of first accepting these terms, from your account email, stating that you opt out of arbitration. Opting out does not affect any other part of these terms.

Governing law and disputes

These terms, and any dispute arising from them or from your use of the app, are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-laws rules. Any dispute that is not subject to arbitration under the section above will be brought exclusively in the state or federal courts located in New Jersey, and both you and Kaltrix consent to their jurisdiction and venue. Nothing in this section removes any mandatory consumer-protection rights you have under the law of the place where you live.

Changes to these terms

We may update these terms as the app evolves. Material changes will be reflected here with a new effective date. Continued use after an update means you accept the revised terms.
